TRAINING AGREEMENT WITH DETAIL SD

By registering for any camp, clinic, training membership, session, or affiliated program with DETAIL SD or ADAPT Academy (operating under the broader brand of By Any Means Basketball), you acknowledge and agree to the following terms and conditions in full:

1. Participation Acknowledgment & Assumption of Risk

I acknowledge that participation in basketball training, athletic performance programs, fitness assessments, or related activities involves inherent risks, including but not limited to strains, fractures, sprains, illness, concussions, or even rare but serious injury or death. I have been informed of, understand, and accept these risks voluntarily.

In consideration for participation in any program offered by DETAIL SD, Activ8, and Play by Play I hereby assume all responsibility for participation and release By Any Means, DETAIL SD, ADAPT Academy, and their officers, coaches, affiliates, representatives, and agents from any and all liability, including claims due to negligent acts or omissions, except in cases of gross negligence or intentional misconduct.

2. Waiver of Liability & Medical Clearance

I confirm that I have received medical clearance to participate or voluntarily choose to participate without physician approval, accepting all risk of doing so. I further waive and discharge DETAIL SD, Activ8, and Play by Play from any and all claims for injury, illness, or damage to personal property connected to participation in any program, whether at a leased facility, offsite, or home-based activity.

3. Refund Policy

ALL SALES ARE FINAL. NO REFUNDS WILL BE ISSUED FOR ANY REASON OR UNDER ANY CIRCUMSTANCE.

This includes but is not limited to: training memberships, private sessions, clinics, and camps. Once payment has been processed, it is non-refundable regardless of attendance, illness, injury, travel conflicts, or schedule changes. All participants are expected to honor their full commitment.

4. Missed Session & Attendance Policy

All missed sessions will be forfeited. We enforce a zero-tolerance missed session policy. Sessions missed for any reason will not be credited, rolled over, refunded, or rescheduled.

Training packages are not eligible for holds, pauses, or freezes under any circumstance.

5. Payment Policy & Fees

A valid credit or debit card must be kept on file at all times.

A $25 fee will be charged for any returned item, failed payment, or insufficient funds.

DETAIL SD is not responsible for any overdraft fees, insufficient fund penalties, or over-limit account charges. Members are responsible for ensuring all charges are processed successfully.

6. Automatic Renewal & Cancellation

Monthly memberships or long-term commitments that extend beyond their minimum required term will continue billing unless canceled in writing, in accordance with any notice period outlined in your membership agreement. Early cancellations are subject to continued charges.

7. Release of Media

I grant By Any Means Basketball, DETAIL SD, ADAPT ACademy and their agents the absolute right and permission to use photographs, video footage, or digital images of myself or my child for lawful promotional purposes, including but not limited to: websites, social media, event marketing, and publications. No compensation will be provided for the use of such media.

8. Marketing, Communication & Trusted Partner Consent

By agreeing to these Terms & Conditions, I give permission for By Any Means Basketball, DETAIL SD, ADAPT Academy, and their trusted partners to contact me regarding promotions, updates, training opportunities, product releases, and other relevant communications through email, phone, text, and digital platforms.

Message frequency may vary. Message & data rates may apply. You may unsubscribe from these messages at any time.

Furthermore, I acknowledge and agree that By Any Means Mountain State may share my contact information with carefully selected trusted partners—such as performance coaches, physical therapists, nutritionists, or local service providers—solely for the purpose of providing beneficial opportunities, exclusive discounts, or relevant offerings that may support the athlete’s or family’s growth, health, and development.

We do not sell or distribute your information to unaffiliated third parties and only share data when it serves the mission of delivering added value to our community through partnerships that are fully vetted and aligned with our standards.

9. Final Acknowledgment

By registering, submitting payment, or participating in any activity or program, I confirm that I have read, understood, and agreed to all of the terms above. This agreement is binding and shall be governed by the laws of the state in which the program is conducted.
