TRAINING AGREEMENT & LIABILITY WAIVER – DETAIL SAN DIEGO

By registering for, purchasing, or participating in any camp, clinic, training membership, session, or affiliated program with DETAIL San Diego (“DETAIL SD”), ADAPT Academy, or any program operated under By Any Means Basketball, you acknowledge and agree to the following terms and conditions:

1. Participation Acknowledgment & Assumption of Risk

I understand that participation in basketball training, athletic performance programs, and related activities involves inherent risks. These risks include, but are not limited to, sprains, strains, fractures, concussions, illness, permanent disability, or, in rare cases, serious injury or death.

I voluntarily choose to participate (or allow my child to participate) with full knowledge and acceptance of these risks.

I acknowledge that these risks may arise from participation in drills, games, training environments, use of equipment, facility conditions, or interactions with other participants.

2. Waiver of Liability & Release (INCLUDING NEGLIGENCE)

To the fullest extent permitted by California law, I hereby release, waive, and discharge DETAIL SD, ADAPT Academy, By Any Means Basketball, Activ8, Play-By-Play Productions, and all affiliated owners, officers, coaches, staff, agents, and representatives from any and all liability, claims, demands, or causes of action arising out of or related to participation in any program.

This includes, but is not limited to, claims arising from the negligence of DETAIL SD or its staff, except in cases of gross negligence or intentional misconduct.

I understand that by agreeing to this, I am giving up certain legal rights, including the right to sue.

3. Medical Clearance & Emergency Authorization

I confirm that I (or my child) am physically able to participate in training activities and have either received medical clearance or voluntarily choose to participate without such clearance.

In the event of an injury or medical emergency, I authorize DETAIL SD and its staff to obtain emergency medical treatment as deemed necessary. I accept full financial responsibility for any medical care provided.

4. Minor Participant Agreement

If the participant is under the age of 18, I certify that I am the parent or legal guardian and have the authority to sign on their behalf.

I agree to all terms of this agreement on behalf of the minor and assume full responsibility for their participation, including all risks outlined above.

5. Indemnification

I agree to indemnify, defend, and hold harmless DETAIL SD, ADAPT Academy, By Any Means Basketball, and all affiliated parties from any and all claims, damages, liabilities, costs, or legal fees arising from participation in any program, including claims brought by or on behalf of the participant.

6. Refund Policy

All sales are final.

Refunds are not provided for any reason, including but not limited to injury, illness, scheduling conflicts, missed sessions, or changes in availability.

In rare and exceptional circumstances, any consideration for account credit or accommodation will be made solely at the discretion of DETAIL SD.

7. Attendance & Missed Session Policy

Participants are responsible for attending all scheduled sessions.

Missed sessions will not be refunded, credited, rolled over, or rescheduled.

Memberships, packages, and training plans are not eligible for holds, pauses, or extensions unless otherwise determined at the sole discretion of DETAIL SD.

8. Payment Policy & Fees

A valid credit or debit card must be kept on file at all times.

A $25 fee will be charged for any failed payment, returned item, or insufficient funds.

DETAIL SD is not responsible for any overdraft fees or bank-related charges incurred by the participant.

9. Automatic Renewal & Cancellation

All memberships and recurring services will continue to renew automatically unless canceled in writing in accordance with the terms outlined in the participant’s membership agreement.

Early cancellation of any commitment may result in continued billing obligations as agreed upon at the time of registration.

10. Facility Use & Third-Party Locations

DETAIL SD programs may be conducted at facilities that are independently owned and operated, including but not limited to Activ8 and Play-By-Play Productions.

DETAIL SD is not responsible for the condition, maintenance, or operations of these third-party facilities.

11. Media Release

I grant permission to DETAIL SD, ADAPT Academy, and By Any Means Basketball to use photographs, video footage, or digital images of myself or my child for lawful promotional purposes, including social media, marketing materials, websites, and publications.

No compensation will be provided for such use.

12. Marketing & Communication Consent

I agree to receive communication from DETAIL SD, ADAPT Academy, and By Any Means Basketball via email, phone, text, or digital platforms regarding updates, promotions, and program opportunities.

Message frequency may vary. Message and data rates may apply. I may opt out at any time.

I also acknowledge that my contact information may be shared with carefully selected and trusted partners (such as performance coaches, physical therapists, or related service providers) for the purpose of providing relevant opportunities and resources.

DETAIL SD does not sell personal information to unaffiliated third parties.

13. Severability

If any portion of this agreement is found to be invalid or unenforceable under California law, the remaining provisions shall continue in full force and effect.

14. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the State of California.

15. Final Acknowledgment

By registering, submitting payment, or participating in any program, I confirm that I have read, understood, and agreed to all terms and conditions outlined above.

I understand that this agreement is legally binding.
